M. 1. In this case.
Goods were consigned by the Firm of Netmore & Co. of Macao, to W. Gillespie for sale at Hongkong; the latter person sold them and refused to account to the Partners of the Firm for the proceeds. One Mehmone and Co. addressed a strong letter to Mr. Gillespie, and told him in it, among other things, that they had felt it to be their duty to warn those friends to whom they had before recommended him. On this Mr. Gillespie instituted an action for slander against Mehmone and Co., with the intention of bringing them to account, and spoke of the award of a Jury leaving a Balance due to him! All the parties are Citizens of the United States of America.
